Should disability discrimination for face mask exemptions be allowed to continue as the David vs Goliath disability discrimination cases that they are forced into when there is an abundance of lawyers/solicitors in the UK, but who are too cowardly to support Litigant in Persons during the claim process?

Kester Disability Rights has only four or five staff, who mostly deal with Personal Independence Payment claims, but since the mandatory face masks were brought into ‘law’, they received hundreds of emails and phone calls for face mask exemption disability discrimination cases per day. Sadly, only ONE law firm helped, but their funding was cut and they went bankrupt. That’s what the brave lawyers get for rising up against the Goliaths of the world, but rise we all should. All others law firms have shied away and shown themselves to be the cowards they are, as have the mental health charities. Shame on them!

It really is David vs Goliath for disability discrimination cases. However, without raising claims, how would change ever come about? It would worsen, as it is today in the GP and NHS services.

We who are disabled are alone and have faced discrimination for face mask exemptions, especially in the health care industry, but it’s showcasing itself to be full of power-hungry neurotic staff who need to victimize and worsen the mental and physical disabilities of those who are mask exempt. Those with the wisdom, capacity, and wealth do not want to help those in need. Mental health is at an all-time high, and heaven knows what neurosis’ children will be facing in years to come.

These big wig charities only care about reputation, too scared to take a stand with David, too afraid of losing their funding. Mental health charities like Mind and Rethink could assist in these face mask exemption disability discrimination cases, but their refusal to budge shows them to be charlatans who proclaim to help, but side with the goliaths.

According to the Equality Act 2010, section 6

Disability

(1)A person (P) has a disability if—

(a)P has a physical or mental impairment, and

(b)the impairment has a substantial and long-term adverse effect on P’s ability to carry out normal day-to-day activities.

If you have already written a letter before claim to the service provider who refused you service, or caused victimization or harassment to wear a mask, when you are exempt, and they have admitted liability in written form, you could get in touch with Kester Disability Rights who work on a 25 percent no win no fee basis. A claim, whether it’s PIP, benefits, or a letter before claim is stressful, especially for the mentally and physically disabled, but look at the world we are living in today? Is this normal behavior to be mistreated for simply expressing our rights to be human, and to be treated humanly and without ill-treatment?

If you struggle to wear a face mask, and the service provider bullies, harasses or victimizes you into wearing one, then they are acting out of their jurisdiction and it is disability discrimination. Even though there are NO law firms who will help, which makes it doubtful that even legal advice would be available through them, as they may just side with public health, but the fact is that the Government allowed exemptions on the face masks/coverings and MANY have been wrongly judged, their condition worsened because of the mistreatment of service providers and this discrimination HAS TO STOP!

Even though the Government has withdrawn its mandatory rulings on face coverings, face masks are still required in NHS and GP surgeries. Please exhort your rights and do not let them get away with disability discrimination if you are mask exempt. The law states that you do not have to state why you are exempt, nor do you need to show proof of exemption, yet those who exercise their rights have been treated unfairly by service providers, and even members of the public have been rude to others. It’s plain wrong and not at all a healthy society.

If you are not able to wear a face-covering

Face coverings are no longer required by law in England but remain a requirement under infection prevention control (IPC) guidance in healthcare settings. There are some circumstances where people may not be able to wear a face covering.

Please be mindful and respectful of such circumstances. Some people are less able to wear face coverings, and the reasons for this may not be visible to others.

This includes (but is not limited to):

  • children under the age of 11 (the UK Health Security Agency does not recommend face coverings for children under the age of 3 for health and safety reasons)
  • people who cannot put on, wear or remove a face covering because of a physical or mental illness or impairment, or disability
  • people for whom putting on, wearing or removing a face covering will cause severe distress
  • people speaking to or providing assistance to someone who relies on lip reading, clear sound or facial expressions to communicate
  • to avoid the risk of harm or injury to yourself or others
  • police officers and other emergency workers, given that this may interfere with their ability to serve the public

Exemption cards

If you have an age, health or disability reason for not wearing a face covering:

  • you do not routinely need to show any written evidence of this
  • you do not need to show an exemption card

This means that you do not need to seek advice or request a letter from a medical professional about your reason for not wearing a face covering.

However, some people may feel more comfortable showing something that says they do not have to wear a face covering. This could be in the form of an exemption card, badge or even a home-made sign.

Carrying an exemption card or badge is a personal choice and is not required by law.

Goliath may be winning, as the law firms shy away from helping with disability discrimination cases regarding face mask exemptions, but it takes bravery to be David vs Goliath and there are so few people taking action in the courts over this ill-treatment of an ill OCD society.

A healthy society is all about having rights that are not trampled on, and yet the face mask exempt have had no voice, but have been harassed and victimized not only by service providers unfairly, but also from other human beings, and it clearly shows the narcissistic behaviors and downright self-righteousness of humankind.

The mentally and physically disabled already struggle day to day with their condition, so why does another influx of stress and anxiety have to evade what little self-respect they have left in defending their rights.

To all of you cowardice law firms, and to you mental health charities, who do you stand for? Do you stand for David or Goliath?

To the NHS and GP surgeries, treat others how you would want to be treated? If you are genuinely afraid of a virus, then stay at home and quit your job as it’s not the right environment for you anymore. Perhaps focus on these vulnerable people and provide leaflets for them in your windows and doors, instead of the ‘you must mask’ intimidation and bullying policy. Apologise for mistreatment. Compensate as you should for mistreating others. Remember your oaths. Please care and do not discriminate. Do not repeat these mistakes, but learn from them.
